Conditions of sale

Article 1 – Customer

Any person making an online purchase from the www.capitoleeditions.com site declares that he/she is of legal age in the country in which he/she resides, and that he/she has the legal capacity or parental authorization to place an order on the Site. When registering personal data during the validation of an order or the creation of an account, the customer must ensure the accuracy of the mandatory data provided. In the event of an error in the recipient’s details, Capitole Editions cannot be held responsible for the non-delivery of the product.

Article 2 – Prices

2.1 The prices indicated in euros include all taxes but exclude shipping costs. Shipping costs are indicated when the customer places the order and before payment is made.

2.2 In the event of a request for delivery abroad, customs duties, local taxes, import duties or state taxes may be payable. These duties and sums are not the responsibility of Capitole Editions and are the sole responsibility of the purchaser.

2.3 Capitole Editions may revise its prices at any time, but products will be invoiced on the basis of the prices in force at the time the order is registered.

Article 3 – Ordering

3.1 Any order implies full acceptance of the present conditions of sale. These conditions cannot be modified by contrary additions made by the customer on the order forms, regardless of when Capitole Editions may have been made aware of them.

3.2 The validation of any on-line order implies the acceptance, by the Internet user, of the entirety of the general terms and conditions, who thereby acknowledges having fully understood them. This acceptance will consist of the Internet user checking the box corresponding to the following sentence: “I have read the general terms and conditions of sale and accept them unreservedly”. This ticking of the box will be deemed to have the same value as a handwritten signature on the part of the Internet user.

3.3 The customer will have the opportunity, before definitively confirming his/her order, to check its details and total price, and to correct any errors, before confirming it to express his/her acceptance. Any order confirmed by the customer constitutes a sales contract and acceptance of all the stipulations herein. Capitole Editions undertakes to send the customer an e-mail confirming all the elements of the order, before the order is dispatched. The customer must therefore provide a valid e-mail address when registering.

3.4 Par l’envoi du bon de commande électronique, le client passe commande ferme et définitive. Toute modification devra faire l’objet d’une nouvelle commande de la part du client.

3.5 Les Multiples ne saurait être tenue responsable de l’inexécution ou de la mauvaise exécution d’une commande en cas de force majeure ou de cause étrangère. Si, dans l’exécution des obligations lui incombant, la responsabilité de Capitole Editions est engagée, le client ne pourra prétendre qu’à des dommages et intérêts qui ne pourront excéder le montant total versé par le client en règlement de la commande en cause, hors frais de livraison.

Article 4 – Payment

4.1 Payment for orders placed with Capitole Editions is made by bank transfer, credit card or Paypal. Payment cards accepted are CB, MasterCard and Visa. The data recorded by the Paypal payment system and/or the payment service provided by Crédit Mutuel constitute proof of the financial transactions.

4.2 Payment is secured by SSL protocol.

Article 5 – Delivery

5.1 The delivery times indicated on the Capitole Editions order form are given as an indication only, unless otherwise stipulated. Any delays do not give the customer the right to cancel the order, to refuse it or to claim damages.

5.2 Capitole Editions cannot be held responsible for the consequences of a delay in delivery.

Article 6 – Conformity

6.1 Capitole Editions undertakes to refund or exchange products that do not correspond to the order. The request must be made within 14 working days of delivery by e-mail to: contact@capitoleeditions.com. Any claim made outside this period will not be accepted. Products must be returned to Capitole Editions in the condition in which they were received, in their original packaging, within 14 working days following the sending of this complaint in writing (e-mail or post).

6.3 Shipping costs will be reimbursed on the basis of the invoiced rate, as well as out-of-pocket return costs, if the return is justified by a quality defect or non-conformity with the order.

6.4 The works are sold as represented on the website www.capitoleeditions.com, Capitole Editions cannot be held responsible for the slightest differences that may exist between the image displayed on the website and the reality of the product.

Article – Applicable law and settlement of disputes

Transactions carried out on the www.capitoleeditions.com website are governed by French law. Any dispute relating to the interpretation or execution of these terms and conditions shall fall within the exclusive jurisdiction of the TOULOUSE courts.
